Being arrested for driving under the influence (DUI) is frightening, overwhelming and stressful. Integrity Health and Wellness understands and respects the different levels of process that goes on. We are well informed in regard to the laws and what comes ahead. We maintain positive relationships with attorneys, probation departments and courts throughout Colorado. Colorado Revised Statute (CRS 42-2-132) requires completion of a OBH licensed Level I or Level II alcohol education and therapy program.
You will deal with over 12 different agencies before this offense is completed legally. Integrity freely offers information to help process the next several steps of the DUI consequences and maneuver through the motor vehicle department, interlock, insurance, probation and court requirements.
Level II Education
Although there are many differences in outcomes to individual cases, you can expect 12 weeks/24 hours of Level II Education. Level II Education can be recommended by itself or may be followed by Level II Therapy. It must done on a weekly basis and face to face.
When Level II Therapy is required it will follow the Education. Tracks can range in length from an additional 5 to 10 months depending on the track assigned. Track assignment depends on whether a person has prior impaired driving offenses, their BAC (or refusal to take a test) and other clinical indicators. These track recommendations are made by the alcohol/drug evaluator (probation) or in the absence of an evaluation, the DUI licensed treatment agency.
Therapy Tracks
Track A, 42 hours over 21 weeks, usually for a first-time offender with a BAC below .15
Track B, 52 hours over 26 weeks, usually for a first-time offender with a BAC of .15 or above or refusal
Track C, 68 hours over 34 weeks, usually for someone with a prior DWAI/DUI, and a BAC below .15
Track D, 86 hours over 43 weeks, usually for someone with a prior DWAI/DUI, and a BAC of .15 or above or refusal
Education and therapy can begin prior to pleading guilty and all classes WILL count toward the court order. In many cases, attending classes will help with a plea agreement. If your case is dismissed, the classes are also required independently from your criminal case. The Motor Vehicle Department will expect at least Level II Education to reestablish or reinstate your driving privileges
Once you accept the plea you will then proceed to the probation department. While on probation you can expect:
- 1-2 year probation term. Note: half way through probation you are eligible for early termination.
- MADD panel $25 money order and available all over the place and at many times and locations
- Random urine testing
- No use of alcohol or drugs
- Community service starting at 24 hours
